Terms and Conditions between Supply Teachers Direct and teachers registering with the database

The following terms and conditions ("Terms") apply to your use of the Supply Teachers Direct Platform which is owned and maintained by Supply Teachers Direct. Please read these Terms carefully. By using the Supply Teachers Direct Service you agree that you have read, understood and agree to these Terms (each as amended from time to time). If you do not agree to these Terms you must not register with or use the Supply Teachers Direct database service.

Introduction

Supply Teachers Direct is the trading name of Supply Teacher Ltd. This is a limited liability company whose registered number is 10180773 and registered address 10 Fairfield, Elham, Canterbury CT4 6UT.

Description of Supply Teachers Direct Service

The Supply Teachers Direct provides a database of teachers to enable schools to contact teachers in order to employ them directly on teaching assignments. Supply Teachers Direct is not an employer, an employment agency or an employment business. Schools and educational institutions are the potential employers and are responsible for compliance with all applicable employment and other related laws. Supply Teachers Direct does not refer or recommend either teachers or schools, and Supply Teachers Direct shall not be responsible for any engagement or employment decisions. Supply Teachers Direct provides a platform through which schools and teachers can connect with each other and where teachers can search for and evaluate potential candidates for supply teaching and longer term appointments, and where teachers can post individual profiles. Supply Teachers Direct is not involved in the actual engagement between teachers and schools and any direct or indirect engagement of a teacher by a school is subject to and governed by separate terms and conditions.

For the purposes of the Conduct of Employment Agencies and Employment Business Regulations 2003 , Supply Teachers Direct is not an employment agency or employment business. It is recommended that, if you are a teacher, you undertake the steps set out in the Regulations to ensure your suitability for the role advertised by a school. These could include: checking the identity of the school and the nature of its business, the commencement date and duration of the position, the position to be filled including type of work, location, hours and risks to health and safety, experience, training, qualifications and authorisation which the school considers necessary or are required by law or otherwise to undertake the position, or whether there are any requirements imposed by law or otherwise for you to satisfy before taking up a position. It is a condition of membership Supply Teachers Direct that schools are obliged to pay the teacher for the teacher's services at the rate which was agreed between the school and the teacher at the commencement of the contract. However Supply Teachers Direct bears no liability for any failure of schools to make such payment to the teacher.

Registration

In order to use the Supply Teachers Direct service you must register an account through the Supply Teachers Direct ("User Account") and in doing so you agree to be bound by these Terms, which shall govern your use of the Supply Teachers Direct Service.

You are only eligible to register a User Account if all information that you use to register is accurate and current. It is your responsibility to keep all your information up to date. It is the responsibility of teachers to ensure that their availability calendar is kept up to date. Supply Teacher reserves the right to suspend or delete the account of teachers who fail to keep their availability calendar updated.

On registering with Supply Teachers Direct, you will be issued with a user name and password which must be used in order to access the Supply Teachers Direct Service. The user name and password are personal to you and are not transferable.

In order to use the Supply Teachers Direct Service you must populate the member profile. You warrant and represent that all information provided on registration and contained in the member profile is, and continues to be, accurate and not misleading.

You consent to the information provided by you on your profile page to be visible and accessible to all Supply Teachers Direct membership schools.

You are responsible for all information posted on the Supply Teachers Direct platform by anyone using your user name and password. Any breach of security of a user name and password should be notified to Supply Teachers Direct immediately.

You may not adapt or circumvent the systems in place in connection with the Supply Teachers Direct Web Platform, nor access the Supply Teachers Direct service other than for the purposes contemplated in these Terms.

Teacher checks

By registering a User Account to use the Supply Teachers Direct Service as a teacher you consent to Supply Teachers Direct using your information to verify such information, including passing onto a third parties, to evaluate the accuracy of the information. Supply Teachers Direct will not seek your further consent prior to carrying out checks and you acknowledge that certain sensitive information may be included in these.

It is a condition of registry with Supply Teachers Direct that teachers must be in possession of a teacher registration number, have a valid DBS, have the right to work in the UK, provide at least two satisfactory references and provide documentation for the purpose of satisfactory identification checks.

It is a condition of continued use of the Supply Teachers Direct service that teachers renew their DBS certificate annual. Failure to ensure renewal will result in suspension or deletion of teacher user account.

It is a condition that upon initial assignment to a new school teachers who have obtained such assignment via the Supply Teachers Direct Service must show the school their DBS certificate and photograph ID. Teachers consent to schools photocopying and retaining copies of such.

Use of Supply Teachers Direct Service

The Supply Teachers Direct Service may only be used by teachers and schools seeking assignments as teachers and by schools seeking the same. You agree to use the Supply Teachers Direct Service only for lawful purposes and in a way which does not infringe the rights of anyone else or restrict or inhibit anyone else's use of the Supply Teachers Direct Service.

You are permitted to download and print content from the Supply Teachers Direct Network solely for your personal use. Supply Teachers Direct Platform content must not be copied or reproduced, modified, redistributed, used or otherwise dealt with for any reason without Supply Teachers Direct's express written permission.

By using the Supply Teachers Direct service, you agree not to:
  • use the Supply Teachers Direct platform, or any information contained therein in any way that is abusive, threatening, obscene, defamatory, libellous, or racially, sexually, religiously, or otherwise objectionable and offensive
  • use another person's User Account without permission;
  • provide false or inaccurate information when registering a User Account, using the Supply Teachers Direct service or communicating with other users;
  • attempt to re-register with the Supply Teachers Direct Service if we have deleted your User account for any reason;
  • interfere or attempt to interfere with the proper functioning of the Supply Teachers Direct Service;
  • bypass any measures Supply Teachers Direct takes to restrict access to the Supply Teachers Direct Service or use any software, technology, or device to scrape, spider, or crawl the Supply Teachers Direct Service or harvest or manipulate data;
  • publish or link to malicious content intended to damage or disrupt another user's browser or computer.

You shall indemnify Supply Teachers Direct in respect of any loss it may suffer as a direct or indirect result of any breach by you of the Use of Supply Teachers Direct Service terms or any other breach by you of these Terms.

Teaching Assignments

Supply Teachers Direct holds no responsibility for teacher assignments and contracts, nor does Supply Teachers Direct hold any responsibility for ensuring that teachers obtain either requests or confirmed bookings for teaching assignments. When entering into an agreement to carry out a teaching assignment the contractual agreement is between the teacher and the school.

You are solely responsible for managing your booking requests, invoicing and all related communications with schools. Supply Teachers Direct shall not be an employer with respect to your use of the Supply Teachers Direct Service and Supply Teachers Direct shall have no responsibility for engagement or employment decisions made by a school.

Payment for initial assignments with schools arranged through Supply Teachers Direct might in some instances be (in the first instance) paid to you by the school gross with no deduction of tax and National Insurance payments. In this scenario it is your responsibility to keep records of payments and file a tax return at the end of the tax year.

Liability

Supply Teachers Direct is not responsible for the quality, safety or legality of the jobs or vacancies offered to teachers via the Supply Teachers Direct Service, or the ability of schools to offer assignments to teachers and Supply Teachers Direct makes no representations about any appointments offered by membership schools.

You agree that the Supply Teachers Direct service is provided without warranty and we do not warrant or represent that the Supply Teachers Direct service will meet your requirements or that its operation will be uninterrupted or error free.

The Supply Teachers Direct platform may contain links to other web platforms. We accept no responsibility or liability for any material supplied or contained on any third party platform or site which is linked from or to the Supply Teachers Direct site, or any use of personal data by such third party.

Terms

Supply Teachers Direct reserves the right, at its sole discretion, to immediately delete your user account with or without notice if Supply Teachers Direct determines that you are not eligible to use the Supply Teachers Direct Service, and/or have violated any of these Terms.

Changes to these Terms

These Terms may be amended by Supply Teachers Direct at its discretion from time to time and the latest version will always be available on the Supply Teachers Direct Platform. Any new version of these Terms shall take effect, and will govern the Supply Teachers Direct Service and your relationship with Supply Teachers Direct.

Privacy

You agree that any and all personal information you provide to us may be collected, stored, processed and used in accordance with our current Privacy Policy.

General

If any of the terms and conditions in these Terms are found to be illegal, invalid or unenforceable by any court of competent jurisdiction, the rest of these terms and conditions shall remain in full force and effect.

Only you and Supply Teachers Direct shall be entitled to enforce these Terms. No third party shall be entitled to enforce any of these terms and conditions, whether by virtue of the Contracts (Rights of Third Parties) Act 1999 or otherwise.

These Terms set out the entire agreement between you and Supply Teachers Direct with respect to your use of the Supply Teachers Direct Service and supersedes any and all representations, communications and prior agreements (written or oral) made by you or Supply Teachers Direct.

These Terms are governed by the law of England and Wales. In the event of any matter or dispute arising out of or in connection with these Terms, you and Supply Teachers Direct shall submit to the exclusive jurisdiction of the courts of England and Wales.

The following terms and conditions ("Terms") apply to your use of the Supply Teachers Direct Platform which is owned and maintained by Supply Teachers Direct. Please read these Terms carefully. By using the Supply Teachers Direct Service you agree that you have read, understood and agree to these Terms (each as amended from time to time). If you do not agree to these Terms you must not register with or use the Supply Teachers Direct database service.

Description of Supply Teachers Direct service

Supply Teachers Direct provides a database of teachers to enable schools to contact teachers in order to employ them directly on teaching assignments. Supply Teachers Direct is not an employer, an employment agency or an employment business. Schools and educational institutions are the potential employers and are responsible for compliance with all applicable employment and other related laws. Supply Teachers Direct provides a platform through which schools and teachers can connect with each other and where schools can search for and evaluate potential candidates for supply teaching and longer term appointments, and where teachers who have been screened by Supply Teachers Direct and hold a valid DBS certificate and have been accepted to the Supply Teachers Direct Register can post individual profiles. Supply Teachers Direct is not involved in the actual engagement between teachers and schools, and any direct or indirect engagement of a teacher by a school is subject to and governed by separate terms and conditions. For the purposes of the Conduct of Employment Agencies and Employment Business Regulations 2003, Supply Teachers Direct is not an employment agency or employment business. Supply Teachers Direct does not guarantee the availability of a teacher to fulfil any assignment request of a school.

Teaching assignments and payment

It is a condition of membership of Supply Teachers Direct that schools are obliged to pay the teacher for the teacher's services at the rate which was agreed between the school and the teacher at the commencement of the assignment. The daily rate for supply teaching assignments can be viewed on each teacher's profile prior to membership schools issuing a supply teaching assignment request. These rates relate to supply teaching assignments as requested and booked via the Supply Teachers Direct website.

Payment process and employment status

Membership schools have the option of employing teachers on any of the following three employment basis:

  1. Self-employed, sole-trader

    The teachers invoices the school upon completion of a particular assignment period. School will pay teachers for each assignment within a maximum of 30 days.

  2. Via an umbrella company

    At the end of the assignment period the teacher’s umbrella company invoices the school. The umbrella company processes the teacher’s pay and deducts tax, the teacher’s NI contribution, the school’s NI contribution, their fee and any appropriate pension contribution.

  3. On your school's payroll

    Membership schools are entitled to employ any teacher on the Supply Teachers Direct register for any number of supply assignments or longer-term contracts at no additional fee to Supply Teachers Direct. In this instance, the school may judge that it is appropriate for the teacher to be placed on the school’s payroll.

All supply assignments must be issued by the school through the Supply Teachers Direct website. In the event that a teacher has carried out an initial supply assignment and a verbal agreement has been made for a further one, this must be formalised through the issue of a request via the website. Should a school wish to cancel an assignment made to and accepted by, a teacher via the Supply Teachers Direct website the school is obliged to provide 24 hours' notice to the teacher. Any assignments falling within the 24 hour period must be paid by the school. Should a school subsequently approach a teacher with an offer of a longer-term contract following an introduction via Supply Teachers Direct then the terms of employment should be appropriate to such and all relevant legislation, and arranged between the school and the teacher. For example in this instance the school and teacher may agree that the teacher will be registered with the school's payroll department. Supply Teachers Direct does not enter into any negotiations or arrangements in relation to any such contracts.

Screening and safeguarding procedures

The director of Supply Teachers Direct is trained and fully conversant in safeguarding procedure. All teachers accepted on the Supply Teachers Direct database are interviewed in person by the director of the company for a minimum of 45 minutes. In compliance with Kent Safeguarding Children Board, Safer Recruitment and Employment policy the following documentation must be produced by the applicant:

  • Original copy of Disclosures and Debarring Service Certificate (Enhanced)
  • Photo ID (passport or driving licence)
  • Certification relating to relevant qualifications (degree and/or PGCE)
  • Evidence of qualified teacher status and teacher registration number
  • Satisfactory references obtained directly from previous employer

Policy relating to Disclosures and Debarring Service certificate

All teachers registered with Supply Teachers Direct must hold a valid DBS.

In relation to DBS portability the following policy has been adhered to:

  1. Teachers are accepted on to the scheme if their DBS has been registered with the DBS updating service and has been annually updated (subject to referencing). Checks are carried out to verify that the teacher's DBS has been updated prior to the teacher being allowed on the register. Ten days prior to the date of renewal an alert is sent to both the teacher and Supply Teachers Direct as a reminder that the DBS is due for renewal. In the event that the teacher fails to renew their DBS they will be removed from the register.
  2. In the instance where a teacher's DBS is not on the update service but is less than a year old, and they have been in continuous employment with the same employee for over a year and satisfactory references are received from the employer, the teacher is accepted on to the register however they are obliged to obtain a new one on the anniversary of the date of registration otherwise they will be removed from the register.
  3. The DBS and date of birth of all teachers is available for schools to view on the teacher profile. Schools have the option of checking the validity of a teacher's DBS by imputing the teacher's DBS, date of birth and surname onto the appropriate update checking section of the Disclosures and Debarring Service website: https://secure.crbonline.gov.uk/crsc/check?execution=e1s1 The results of such are instantaneous.
  4. It is the responsibility of schools to check the photo ID and DBS certificate of all teachers upon their initial assignment at the school and to verify that they match the details of that on the teacher profile. Supply Teachers Direct accepts no responsibility for failure to enforce such. Supply Teachers Direct applies a rigorous vetting procedure and takes all reasonable steps to ensure that teachers on the database are fully screened, however Supply Teachers Direct does not accept responsibility for any unforeseen conduct by teachers on the database.

The DBS and date of birth of all teachers is available for schools to view on the teacher profile. Schools have the option of checking the validity of a teacher's DBS by inputing the teacher's DBS, date of birth and surname onto the appropriate update checking section of the Disclosures and Debarring Service website. The results of such are instantaneous. In the instance of any teacher falling within category 3 above (because a teacher has not registered with the update service) Supply Teachers Direct is happy to provide schools with the teacher's reference from present or last employer. Supply Teachers Direct applies a rigorous vetting procedure and takes all reasonable steps to ensure that teachers on the database are fully screened, however Supply Teachers Direct does not accept responsibility for any unforeseen conduct by teachers on the database.

It is the responsibility of schools to check the photo ID and DBS certificate of all teachers upon their initial assignment at the school and to verify that they match the details of that on the teacher profile. Supply Teachers Direct accepts no responsibility for failure to enforce such.

Teaching Standards

Supply Teachers Direct does not make any particular recommendations in relation to the specific expertise of teachers on the database. All teachers have been interviewed and fully screened as set out in ‘Screening and safeguarding' however the decision to offer supply assignments is made by the membership school after viewing information on their profile (c.v and biography). Supply Teachers Direct bears no responsibility for any teaching performance judged to be poor by a membership school. Supply Teachers Direct does not invite feedback from schools on teacher performance however in the event that a school should have any concerns in relation to a safeguarding or child protection issue we request that we are notified. We would also wish to be notified should a teacher conduct themselves in a manner which breaches generally accepted protocol.

Registration

In order to use the Supply Teachers Direct service individual membership schools must register an account through the Supply Teachers Direct ("User Account") and in doing so you agree to be bound by these Terms, which shall govern your use of the Supply Teachers Direct Service.

You are only eligible to register a User Account if all information that you use to register is accurate and current. It is your responsibility to keep all your information up to date. On registering with Supply Teachers Direct, your school will be issued with a user name and password which must be used in order to access the Supply Teachers Direct Service. The user name and password are specific to your school's account and are not transferable. The annual membership fee for each school is set in accordance with the number of pupils on roll. In the instance where a school forms part of a chain, federation, academy trust or any other such structure in which the school is one of a number of related intuitions, the membership school is strictly forbidden from allowing partner schools from accessing their account. Any abuse of this i.e in the event that a membership school should allow a non-membership school access to the Supply Teachers Direct database, either formally or informally, through permitting access or indirectly approaching teachers on the database on behalf of non-membership schools, or verbally providing information of registered teachers to a third party would be regarded as a breach of data confidentially under the Data Protection Act and result in the immediate cancellation of the membership school's account and appropriate legal action. In this event the school's membership will be non-refundable.

You are responsible for all information posted on the Supply Teachers Direct platform by anyone using your user name and password. Any breach of security of a user name and password should be notified to Supply Teachers Direct immediately.

Use of Supply Teachers Direct Service

The Supply Teachers Service may only be used by schools seeking teachers and teachers responding to requests by schools. You agree to use the Supply Teachers Direct Service only for lawful purposes and in a way which does not infringe the rights of anyone else or restrict or inhibit anyone else's use of the Supply Teachers Direct Service.

Supply Teachers Direct Platform content must not be copied or reproduced, modified, redistributed, used or otherwise dealt with for any reason without Supply Teachers Direct's express written permission. .

By using the Supply Teachers Direct service, you agree not to:

It is the school's responsibility to ensure their compliance with ruling IR35. Supply Teachers Direct accepts no liability if HMRC perceives any breach of this ruling.

Timeframe for Accepting Booking Requests

During normal working hours (8.30am to 5pm) a teacher must accept a booking request within 2.5 from the time of issue. (*) If the request is not accepted by the teacher after this time the school is entitled to issue a separate request to a different teacher and is resolved from any obligation to employ or pay the teacher of the initial request. Notwithstanding the teacher in receipt of the initial request may accept the request if it is still available however the school is not obliged to accept their acceptance if the vacancy has subsequently been filled. The 2.5 hour acceptance period applies to all booking requests issued between the hours of 8.30am and 5pm for a booking period within 48 hours of the time of issue. The following acceptance hours apply in relation to other periods:

7am to 8.30am = 15 minutes for booking requests for same day bookings, 2.5 hours for requests relating to bookings periods within 48 hours.

5pm to 9.30pm = 30 minutes for booking requests for the following day, 2.5 hours for requests relating to booking periods within 48 hours.

9.30pm to 7am = up to 7.15am on the following day for booking requests for the same day, 2.5 hours for requests to booking periods within 48 hours.

For all booking requests relating to advance booking periods (more than 48 hours in advance) a teacher must accept a request within 4 hours from the time of issue otherwise point (*) above applies.
